1. About these terms
These terms apply to your use of novovitabio.com (the "website") and to enquiries you make through it. The website is operated by NovovitaBio ("we", "us", "our"). By using the website you agree to these terms. If you do not agree, please do not use it.
Our laboratory services are provided under separate written terms agreed with you, as described in section 3. Where those written terms conflict with these terms, the written terms apply to the services.
2. Website content is general information
The content of the website describes our services at a general level. It is provided for information only and is not medical, clinical, legal or other professional advice, and nothing on it constitutes a clinical diagnosis or a recommendation for any treatment.
We take care to keep the content accurate and up to date, but we do not guarantee that it is complete or error-free, and it may change without notice.
3. Our services
Submitting an enquiry through the website does not create a contract between us. A contract for services exists only when we have agreed the scope, deliverables, price and timing with you in writing (for example a quotation or service agreement that you have accepted).
We may decline or end any project at our discretion, for example where it falls outside our capabilities, raises safety, ethical or legal concerns, or cannot be carried out properly.
If you provide samples, materials or data, you confirm that you are entitled to provide them, that they were obtained lawfully, and that you hold any consents, ethical approvals or permissions needed for us to work with them. You must tell us about any known hazards. We may refuse, return or safely dispose of material that is unsuitable, unlabelled, or unsafe.
4. Research use and diagnostic work
Unless we expressly agree otherwise in writing, our services, including RT-PCR and other molecular diagnostic procedures, are provided for research and informational purposes only. They are not clinical diagnostic tests, and their results must not be used as the sole basis for any medical or clinical decision.
If your project has clinical, regulatory or accreditation requirements, tell us when you first get in touch so that we can say plainly whether and how we can meet them before any work begins.
Laboratory results depend on the quality of the material supplied and on the limits of the method used. We will report results together with relevant limitations.
5. Research project support and academic integrity
Our research project support consists of laboratory support, experimental guidance, technical assistance, methodology support and help with laboratory procedures and the interpretation of data. It is intended to help you carry out and understand your own work.
We do not complete academic assignments, dissertations, theses or other assessed work on anyone's behalf, and we will not knowingly assist in breaching academic rules. You are responsible for the design, analysis and written content of your project and for complying with the rules of your institution, including any requirement to disclose or acknowledge external support.
6. Using the contact form
Please give accurate information when you submit an enquiry. Do not include patient-identifiable information, health records or confidential third-party information in the form. We handle the information you provide as described in our Privacy Policy.
7. Acceptable use
You must use the website lawfully and responsibly. You must not:
- submit false, misleading, abusive or unlawful content, or send spam or bulk or automated enquiries;
- attempt to gain unauthorised access to the website, our servers, databases or other users' information;
- probe, scan or test the security of the website, or interfere with or overload it, without our prior written permission;
- introduce malware or other harmful code;
- copy or scrape the website at scale, or use it to build a competing database or service.
We may block access, remove content or report conduct to the relevant authorities if we believe these rules have been broken. Unauthorised access to computer systems is a criminal offence in many countries.
8. Reporting security issues
If you believe you have found a security vulnerability in this website, please email contact@novovitabio.com with enough detail for us to reproduce it. Please give us a reasonable time to investigate and fix it before you disclose it publicly, do not access, change or delete anyone else's data, and do not disrupt the service. We will not take action against people who report issues in good faith and follow these guidelines.
9. Intellectual property
The website, including its text, design, graphics, name and logo, belongs to NovovitaBio or its licensors and is protected by intellectual property laws. You may view it and share links to it, but you may not copy, adapt or reuse its content or branding without our prior written permission.
Unless we agree otherwise in writing, you keep ownership of the samples, materials and data you give us, and the results we produce for you are for your use. We keep ownership of our pre-existing protocols, methods, know-how and tools, and of anything we develop independently of your project.
10. Confidentiality
We treat non-public information you share with us for the purpose of an enquiry or project as confidential, and we use it only for that purpose. This does not apply to information that is already public, that you have made public, that we already held or developed independently, or that we are required by law, a court or a regulator to disclose. If you need a formal non-disclosure agreement, tell us before sharing sensitive material.
11. Availability and third-party links
We aim to keep the website available but do not guarantee uninterrupted or error-free access, and we may suspend or change it at any time, for example for maintenance or security. The website may link to third-party sites. We do not control them and are not responsible for their content.
12. Limitation of liability
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any statutory rights you have as a consumer.
Subject to that, and to the paragraph below:
- the website is provided "as is", and we are not liable for loss arising from your use of, or reliance on, its general content;
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, opportunity, goodwill or data;
- our total liability to you for any claim arising from a service is limited to the fees you paid us for that specific service, unless your written agreement with us says otherwise.
We are not responsible for delay or failure caused by events outside our reasonable control, including equipment failure, supply shortages, utility or network outages, or changes in law.
13. Privacy
Our Privacy Policy explains how we collect and use personal information and forms part of these terms.
14. Changes to these terms
We may update these terms from time to time. The updated version applies from the date it is published on this page, and your continued use of the website means you accept it.
15. Governing law and general provisions
These terms, and any dispute arising out of them or the website, are governed by the laws of the country in which NovovitaBio is established, and the courts of that country have exclusive jurisdiction. This does not affect any mandatory consumer rights you have in the country where you live.
If any part of these terms is found to be unenforceable, the rest remains in effect. A failure by us to enforce a right is not a waiver of it. These terms, together with any written agreement for services, are the whole agreement between us about the website and replace any earlier understanding about it.
16. Contact us
